Summary of the Complaint

Case No. 25‑CV‑1473, U.S. District Court for the District of Puerto Rico
Filed September 5, 2025

This is a personal injury / premises liability tort action brought by a Connecticut resident after she slipped and fell at Luis Muñoz Marín International Airport (LMM) in San Juan, Puerto Rico. The suit seeks at least $1,000,000 in damages and is based on Puerto Rico negligence law (Articles 1536 & 1540 of the Civil Code, 31 L.P.R.A. §§ 10801, 10805) plus direct actions against insurers.

Key Parties

Plaintiff

Lourdes Luciano, 57 years old, citizen and resident of Connecticut.

Defendants

(All sued jointly and severally)

  • Aerostar Airport Holdings, LLC – Owner/operator of LMM Airport.
  • Prime Janitorial Service Corp. – Contracted maintenance/janitorial company responsible for cleaning the airport.
  • Starr Indemnity & Liability Company – Liability insurer for one or more defendants.
  • MAPFRE Praico Insurance Company – Liability insurer for one or more defendants.
  • ABC Insurance Companies – Unknown insurers.
  • Does I–X – Unknown additional joint tortfeasors.

Core Facts Alleged

  • On June 30, 2025, Ms. Luciano was walking to Gate B10 at LMM Airport to catch her flight back to Connecticut.
  • She suddenly slipped on a wet floor with no warning signs or caution cones present.
  • She fell hard on her left (dominant) side, heard a loud “cracking” sound, and immediately suffered intense pain. Her left wrist was visibly deformed (“hanging”).
  • She became soaked from knee to shoulder. Airport security arrived, helped her, took an incident report (which she was not given a copy of), and mopped the area afterward, then placed a sign and took a photo.
  • Her flight was delayed; she boarded in severe pain.
  • Upon landing in Connecticut, she went to New Britain Hospital and was diagnosed with a compound wrist fracture in three places.
  • Surgery was performed on July 10, 2025, at Hospital for Central Connecticut (fusion performed).
  • She required immobilization, remains in physical therapy, cannot use her dominant hand normally, and needs help with daily activities (showering, cooking, etc.). It is unknown whether she will regain full mobility, strength, or grip.
  • She was previously fully independent; the injury has caused ongoing pain, emotional distress, and loss of enjoyment of life.

Legal Claims

(Six Causes of Action)

  1. Negligence against Aerostar – Failure to maintain safe premises, inspect, clean spills promptly, warn guests, or use non‑slip flooring (premises liability).
  2. Negligence against Prime Janitorial – Failure to follow proper cleaning and maintenance protocols and prevent hazardous wet‑floor conditions.

  4. Direct action against MAPFRE Praico Insurance Company under Puerto Rico’s direct‑action statute.
  5. Direct action against ABC Insurance Companies under Puerto Rico’s direct‑action statute.
